Terms of Service

1. Operator and acceptance

Hearsay ("the Service", accessible at hearsay.market) is operated by Sumiyoshi Giken (住吉技研), Kobe, Japan ("we", "us"). By using the Service you accept these Terms. If you do not accept them, do not use the Service.

2. The Service

Hearsay is a forecast market for public events. Users post and view forecasts about verifiable upcoming events (earnings, elections, launches, macro data). Forecasts are scored on resolution against public sources. The Service uses an internal credit ("IC") for ranking and reputation. Hearsay is not a gambling or wagering service: IC is not redeemable for cash and is not a financial instrument.

3. Eligibility

You must be at least 16 years old (or the age of digital consent in your jurisdiction). You must have legal capacity to enter into this agreement. You are responsible for compliance with the laws of the country from which you access the Service.

4. Account

• You are responsible for activity under your account.
• One account per person; multiple accounts to manipulate forecasts are prohibited.
• We may suspend or terminate accounts that violate these Terms.

5. Acceptable use

You will not:

• Post defamatory, harassing, illegal, or hateful content.
• Forecast on private individuals (non-public figures) or non-public events.
• Manipulate forecasts via Sybil accounts, coordinated voting, or automated abuse.
• Submit insider, leaked, or non-public material information.
• Attempt to reverse-engineer, scrape, or attack the Service.
• Infringe the intellectual-property rights of others.
• Use the Service for money laundering or other illegal purposes.

6. Payments and IC credits

• Browsing and submitting forecasts is free.
• IC credits and premium features are sold via Stripe in the currency shown at checkout.
• Prices include applicable consumption tax where required.
• Subscriptions auto-renew until cancelled. You can cancel any time from account settings.
• Refunds: by default, IC purchases and subscription periods already consumed are non-refundable. Refunds for unused, unconsumed purchases may be granted within 14 days of purchase at our discretion. See 特定商取引法に基づく表記 for details.
• Failed payments may result in suspension of paid features.

7. Content and license

You retain ownership of content you submit. You grant Hearsay a worldwide, non-exclusive, royalty-free license to host, display, and distribute your content as needed to operate the Service. You represent you have the rights to submit the content.

8. Removal and moderation

We may remove content that violates these Terms, applicable law, or our community guidelines. To request removal of content about you, see our content removal page.

9. Disclaimers

Forecasts on Hearsay are user-generated opinions, not investment, legal, medical, or professional advice. The Service is provided "as is" without warranties of any kind. We do not guarantee uninterrupted availability, accuracy of forecasts, or correctness of resolutions.

10. Limitation of liability

To the fullest extent permitted by law, Sumiyoshi Giken shall not be liable for indirect, incidental, special, or consequential damages, lost profits, or loss of data arising from your use of the Service. Our aggregate liability shall not exceed the amount you paid us in the 12 months preceding the claim, or JPY 10,000, whichever is greater.

11. Indemnification

You agree to indemnify and hold us harmless from claims arising from your content, your violation of these Terms, or your violation of applicable law.

12. Termination

You may stop using the Service at any time. We may suspend or terminate your access for breach of these Terms or for legal, security, or operational reasons.

13. Changes

We may update these Terms. Material changes will be notified via the site or email. Continued use after changes constitutes acceptance.

14. Governing law

These Terms are governed by the laws of Japan. Exclusive jurisdiction is the Kobe District Court (神戸地方裁判所), Japan.
